By using the Vernier platform — including all modes, tools, calculators, and free resources available at vernier.io — you acknowledge and agree that:
2.1 You are solely responsible for reviewing all platform outputs before using them in any bid, proposal, contract, or client communication.
2.2 You are solely responsible for verifying that all quantities, unit costs, labor rates, material pricing, code references, and scope language are accurate, current, and appropriate for your specific project, market, and conditions.
2.3 You are solely responsible for ensuring your bids comply with all applicable federal, state, and local laws, codes, regulations, licensing requirements, and prevailing wage obligations.
2.4 You are solely responsible for the final numbers you submit. Submitting a bid based on Vernier outputs does not transfer any portion of that responsibility to Aviat Group, LLC or the Vernier platform.
2.5 You understand that AI-generated estimates can contain errors, omissions, outdated pricing, or inapplicable assumptions — and you accept that risk when you use the platform.
By accessing or using the Vernier platform, you agree to hold harmless, defend, and indemnify Aviat Group, LLC, its owner, employees, agents, contractors, and successors from and against any and all claims, damages, losses, costs, and expenses — including reasonable attorney's fees — arising out of or related to:
This hold harmless provision applies regardless of whether the loss results from platform error, data inaccuracy, user error, or any combination thereof.
4.1 Aviat Group, LLC provides the Vernier platform "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose, or merchantability.
4.2 Aviat Group, LLC does not warrant that platform outputs will be error-free, complete, current, or suitable for any specific project or market condition.
4.3 In no event shall Aviat Group, LLC be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the platform — including but not limited to lost profits, lost bids, contract losses, project cost overruns, or reputational harm — even if Aviat Group, LLC has been advised of the possibility of such damages.
4.4 In any event where liability cannot be fully disclaimed under applicable law, the total cumulative liability of Aviat Group, LLC to you shall not exceed the greater of: (a) the total amount paid by you to Aviat Group, LLC for platform access in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00 USD).

Aviat Group, LLC does not control and does not warrant the accuracy, timeliness, or completeness of any third-party data incorporated into platform outputs.
